1. Scope

This policy explains how ButtonMashers ("we", "us") processes information when you use BerryPic. BerryPic processes a photo only when you request an AI transformation.

2. Information We Process

  • Selected photos and prompts: the photo you choose and the style instructions required for an AI transformation.
  • Local app data: creations, overlay edits, favorites, theme choices, and credit balances stored on your device.
  • Technical data: IP address, request time and status, device and app information, and security or rate-limit events.
  • Advertising data: Google and its advertising partners may process device identifiers, advertising ID, IP address, approximate location, diagnostics, ad interactions, and consent choices.

3. Photo and AI Processing

When you request an AI transformation, BerryPic compresses the selected photo and sends it over HTTPS to a Cloudflare Worker. The request may be processed by Cloudflare Workers AI or deAPI.ai.

BerryPic may also use Pollinations.ai as a fallback. In that case the photo is uploaded to Pollinations media storage and supplied to its generation service through a hosted URL. Pollinations states that hosted media normally has a 30-day lifecycle and may remain longer when accessed.

BerryPic does not operate a permanent cloud gallery or use submitted photos to train its own models. External providers apply their own logging, retention, backup, safety, and model-processing practices. For example, deAPI states that it uses a distributed network of third-party computers, so it cannot guarantee the confidentiality of data processed there and content may be retained on those systems.

Local overlay editing does not require an AI upload unless you separately start an AI transformation.

Only upload photos you have the right to use, and do not upload photos of other people without their permission.

4. Service Providers

Processing may occur outside your country, including in the United States. Where required, transfers rely on safeguards such as Standard Contractual Clauses, as applied by each provider under its own privacy policy.

5. Advertising Choices

Where required, BerryPic shows a consent message before requesting ads. You can change your choice later in Settings > Ad Privacy Choices, and you can reset or limit your advertising ID in Android settings. Refusing personalized ads does not remove every ad; contextual or limited ads may still appear.

Sharing identifiers with ad partners may count as a "sale" or "sharing" of personal information, or as "targeted advertising," under some US state laws. You can opt out through Ad Privacy Choices. We do not sell your photos.

6. Purposes and Legal Bases

  • To provide the transformation you request (performance of the service).
  • To operate and secure the service, prevent abuse and fraud, enforce spending limits, and maintain reliability (legitimate interests).
  • To show and measure ads, with your consent where the law requires it. You can withdraw consent at any time in Ad Privacy Choices.
  • To comply with legal obligations.

7. Retention and Deletion

  • Creations, preferences, and credits stay on your device until you delete them, clear app data, or uninstall BerryPic. App data is excluded from Android cloud backup and device transfer.
  • Photos sent for AI transformation are used to complete your request. [Our Worker does not store your photo after the request finishes. Confirm this is true.]
  • Rate-limit counters remain for their applicable window. Security logs, which may include IP address and request status, are kept for up to [30] days.
  • External providers apply their own retention periods. Deleting a local image does not delete a Pollinations-hosted upload.

8. Your Rights

Depending on where you live, you may have the right to access, correct, delete, restrict, or object to processing; get a portable copy; withdraw consent; appeal a decision; or opt out of targeted advertising, sale, or sharing. We will not treat you unfairly for using these rights.

Use BerryPic's deletion controls or clear app data to remove local content. Contact the relevant provider about data it controls, or contact us for help. We aim to reply within 30 days. If you are in the EEA, UK, or Switzerland, you can also complain to your local data protection authority.

9. Children

BerryPic is for a general audience aged 13 or older, and 16 or older where that is the digital-consent age. We do not knowingly collect personal information from younger children. If you believe a younger child has submitted information, contact us and we will delete it.

10. Security

We use HTTPS/TLS and reasonable safeguards. No internet service can guarantee absolute security.

11. Changes to This Policy

We may update this policy. We will change the effective date above and, for material changes, show a notice in the app or on the store listing.
